Egg donation, sperm donation and surrogacy has been legal in Georgia since 1997. Surrogate mothers have no parental rights over babies they give birth to for the purpose of gestational surrogacy. The couple or the single mother is the legal parent of the child born from a surrogate mother.

No consent from the surrogate is required. Even if an embryo was donated, the surrogate mother or donor has no parental rights over the child. The child’s birth certificate will be issued immediately (at most 1 day) after birth and the couple or single mother will be registered as the child’s parent on the birth certificate, not the surrogate.  The following documents are required for registration of the couple as parents: Surrogacy Agreement made by the couple
